You do an out-of competition test outside the testing window, the athlete welcomes you in and takes the test (which he was in no way obligated to do since it was outside the window), the A sample shows positive for EPO (but the procedure was not observed by any outside witnesses) and the B sample comes up negative on a witnessed procedure. 

This is a B-quality rider for a lesser team so you skewer him by using your ability to circumvent the negative B sample, knowing full well he does not have the funds or backing to pull a Sky defense.  This is a 33 yo rider.  Give him a year off and he will just go away.

I hope someone with deep pockets see this and decides this just isn't right.
