It nicely sums up the paradigm shift that needs to happen wrt liability. Not just car/cycling incidents but also pedestrian.

Getting into a car is basically putting on a 2 ton suit of armor, and by rights you should be responsible for a heightened sense of awareness when dealing with people less suitably equipped (cyclists and pedestrians). Traffic laws should not grant one immunity from liability. The Netherlands does it right.

Holy shht....it is 'open season' on cyclist and pedestrians in NYC! Cars rule without repercussion.

Profoundly depressing. It seems that 'someone important' or their kid must be run down and maimed / killed by an auto before real change will occur.

That cab case is simply amazing. That should be two counts of assault with a deadly weapon, at least.

In BC strict liability is imposed in car pedestrian accidents. That means a car driver has to prove he was not negligent. Normal liability places the burden of proof upon the plaintiff. Perhaps that should be the case with car bike accidents too?

I read the original article in the Times and was surprised by the comments of readers, many of whom, as pedestrians, had stories of near misses with a$$**** cyclists. They didn't go so far as to suggest that motorists were justified in running us down, but we cyclists don't have a lot of residual good will among some of the people who responded. If this is the sentiment of Times readers, I can only imagine what it would be at, say, the Omaha World Herald.

In the cab incident, no-one is worried about the bike messenger that the cab drove through to get to the tourist, only the tourist.
